CRAFTED PIXEL – CLIENT TERMS AND CONDITIONS
1. About Us
Crafted Pixel (“we”, “us”, “our”) provides web design, development, and related digital services.
2. Acceptance of Terms
By accepting a quote, signing a proposal, or making any payment, the Client agrees to be bound by these Terms and Conditions.
3. Scope of Work
3.1 All services will be detailed in a written quotation or proposal.
3.2 Any work requested outside of the agreed scope may result in additional charges.
4. Deposits and Payments
4.1 A non-refundable deposit of 50% of the total project fee is required before work begins. This deposit secures scheduling, planning, and allocation of resources.
4.2 The remaining balance will be invoiced in agreed stages or upon completion.
4.3 All invoices are payable within 7 days unless otherwise stated.
4.4 Crafted Pixel reserves the right to suspend work or withhold deliverables if payment is not received.
5. Project Stages and Approval
5.1 Projects may be divided into stages (e.g. design, development, launch).
5.2 The Client will have the opportunity to review and approve each stage. Approval may be given in writing or by conduct (including requesting further work).
5.3 Once a stage has been approved, it is deemed accepted and will not be eligible for refund.
6. Refunds and Cancellations
6.1 The initial 50% deposit is non-refundable except where required by law.
6.2 If the Client cancels a project after work has commenced, no refunds will be provided for work already completed or time allocated.
6.3 If the value of work completed exceeds the deposit paid, the Client agrees to pay for all work carried out up to the cancellation date.
6.4 Once a project or project stage has been completed and approved, no refunds will be provided for that work.
6.5 Nothing in these Terms affects the Client’s statutory rights.
7. Client Responsibilities
7.1 The Client agrees to provide all content, materials, and feedback required to complete the project in a timely manner.
7.2 Delays caused by the Client may result in timeline changes or additional charges.
7.3 The Client is responsible for ensuring that all materials provided do not infringe third-party rights.
8. Access and Project Interference
8.1 The Client agrees to provide and maintain all necessary access to websites, hosting accounts, and third-party platforms required for Crafted Pixel to perform the services.
8.2 Crafted Pixel shall not be responsible for delays or failure to deliver where access is restricted, delayed, or removed.
8.3 If access is restricted or removed after work has begun:

Work may be suspended immediately

Project timelines will be paused or revised

The Client remains liable for all work completed and time allocated
8.4 If access is not restored within a reasonable timeframe, Crafted Pixel reserves the right to terminate the project. In such cases, no refunds will be issued and any outstanding fees become immediately payable.
8.5 Crafted Pixel is not responsible for issues caused by third-party changes made without its knowledge or approval.
9. Intellectual Property
9.1 All work remains the property of Crafted Pixel until full payment has been received.
9.2 Upon full payment, ownership of final agreed deliverables transfers to the Client, unless otherwise agreed in writing.
9.3 Crafted Pixel reserves the right to showcase completed work in its portfolio and marketing.
10. Liability
10.1 Crafted Pixel will provide services with reasonable care and skill.
10.2 Crafted Pixel shall not be liable for any indirect or consequential loss, including loss of profit, business, or data.
10.3 Total liability shall not exceed the total fees paid for the services.
10.4 Nothing in these Terms excludes liability where it would be unlawful to do so.
11. Hosting and Third-Party Services
11.1 Crafted Pixel is not responsible for downtime, outages, or failures caused by third-party providers.
11.2 Hosting, maintenance, or ongoing services may be subject to separate agreements.
12. Termination
12.1 Either party may terminate the project with written notice.
12.2 The Client agrees to pay for all work completed up to the termination date.
12.3 All outstanding invoices must be settled before release of files or transfer of services.
13. Data Protection
13.1 Both parties agree to comply with applicable data protection laws, including UK GDPR and the Data Protection Act 2018.
13.2 The Client is responsible for ensuring they have the right to provide any personal data shared.
14. Governing Law
These Terms shall be governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Updates to Terms
Crafted Pixel reserves the right to update these Terms. The latest version will apply to all new agreements.
